Detention Pond Development Update

As the Managing Agent for Sanger Circle Homeowner’s Association, Inc., we have an important announcement regarding recent developments to the detention pond area in the community.

The Sanger Circle Homeowners’ Association has entered into an agreement with Forestar Real Estate Group Inc. to allow their adjacent Willowstone Subdivision development to use our detention pond for stormwater drainage. In return, the Board of Directors, along with Essex Association Management, have negotiated the reception of the benefits outlined below.

Summary of Community Benefits – Sanger Circle HOA & Forestar Agreement

Negotiated Upgrades & Improvements to the Pond Area

Forestar will construct and fund the following improvements for shared benefit of both communities:
• One-Time Payment: A $10,000.00 lump sum payment to the HOA upon official recording of the easement.
• Sidewalk Trail: A 5-foot-wide concrete walking trail around the pond, matching existing Sanger Circle sidewalks.
• Retaining Wall: To stabilize the slope on the northeast corner of the pond.
• Sod and Irrigation System: Seeding, sodding, and installation of a professional irrigation system to keep the area green and minimize standing water.
• Fish Restocking: The pond will be restocked with bass, bluegill, minnows, and catfish once improvements are complete.
• Benches and Trash Cans: Two concrete pads with benches and metal trash cans for community enjoyment.
• Tree Planting: Ten new live oak trees (3” caliper) will be planted within the pond area.

Inspection and Long-Term Protection

All improvements will be inspected by a licensed third-party engineer at Forestar’s expense.
• The HOA retains ownership and long-term responsibility for maintenance of the land and improvements.
• Forestar may perform repairs only if HOA fails to maintain functionality for stormwater flow — and must be reimbursed if so.

Land Acquisition & Development

Forestar will convey a 0.31-acre parcel of land (the “Triangle Lot”) adjacent to the detention pond to the HOA at no additional cost.
• This land will be used to reduce slope erosion and enhance protection of the pond area.
• It will be permanently designated as open space with no vertical structures allowed.

Prior to Development

Before Forestar breaks ground around the pond area, we are asking homeowners to pleasebe mindful of the following:
• During development, we strongly urge homeowners to keep away from the easement area. Not only is the purpose of this to ensure the safety of our homeowners, but to also allow Forestar to work as efficiently as possible.
• Due to the “Fish Restocking” agreement, the Board of Directors has encouraged that all interested homeowners fish the pond on a catch-and-keep basis until the area closes for development.
